Terms of Service

1. Agreement to Terms

By accessing or using Scene Battle (scenebattle.com), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use our services. These Terms constitute a legally binding agreement between you and Scene Battle, operated from Tennessee, United States.

2. Eligibility — 18+ Requirement

You must be at least 18 years of age to create a Scene Battle account or make a purchase. By creating an account, you confirm that you are 18 or older. Scene Battle accounts are adult accounts only. Children do not create independent accounts. Parents and guardians may create child sub-profiles within their adult account, subject to our Parental Consent Policy.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account, including any activity by child profiles you create. Notify us immediately at support@scenebattle.com if you suspect unauthorized access to your account. Scene Battle is not liable for losses resulting from unauthorized use of your account.

4. Script License

When you purchase a Scene Battle script, you receive a limited, non-exclusive, non-transferable, non-sublicensable license to perform and film that script once per purchase for personal, non-commercial, social media, and educational use only.

You may not: redistribute, resell, or share the script with non-participants; use the script for commercial theatrical or broadcast production without a separate license; remove or alter the watermark; or reproduce the script in any public-facing format. Scene Battle retains all intellectual property rights in its scripts, story concepts, characters, and branding.

5. Credits and Payment

Scene Battle uses a credit system. Solo Credits ($10 each) unlock solo monologue scripts. My Crew Credits ($20 each) unlock full cast scripts for 2–8 participants. Credits are purchased by adult account holders using a valid payment method processed by Stripe.

Credits do not expire and are non-transferable between accounts. Credits have no cash value and cannot be redeemed for cash. Scene Battle reserves the right to modify credit pricing with notice to existing users.

6. Digital Products — No Refund Policy

Scene Battle sells digital products (drama scripts and edited video production services). All sales are final. Scripts are non-refundable once accessed or downloaded. Editing credits are non-refundable once the editing process has been initiated.

Exceptions: We will issue a refund or credit if (a) you were charged twice for the same purchase due to a technical error, or (b) a technical failure on our end prevented you from accessing a script you purchased and we are unable to resolve the issue within 5 business days. To request a refund under these exceptions, email support@scenebattle.com within 14 days of purchase with your order details.

Chargebacks filed outside of this policy will result in permanent account suspension and may be disputed.

7. Video Upload and Content License

By uploading video content to Scene Battle, you represent and warrant that: you own or have the right to use all content in the video; no person depicted in the video has objected to their inclusion; for videos involving minors, you are the parent or legal guardian of each minor depicted and consent to their inclusion; and the content does not infringe any third-party intellectual property rights.

By uploading, you grant Scene Battle a worldwide, royalty-free, non-exclusive license to edit, brand, transcode, reproduce, distribute, publicly display, and publicly perform your video content for the purpose of: producing your edited Scene Battle video; delivering it to you; and, if you opt in, posting it to Scene Battle's social media channels (TikTok, YouTube) and featuring it in the Scene Battle feed.

You retain ownership of your original footage. Scene Battle retains ownership of the edited, branded final video it produces. You receive a copy of the edited video for personal use and social sharing.

8. Prohibited Content

You may not upload content that is: sexually explicit or suggestive; violent, threatening, or harmful; hateful, discriminatory, or harassing; illegal; involving non-consenting individuals; involving minors in any inappropriate context; or in violation of any third-party intellectual property rights (including unlicensed background music). Scene Battle reserves the right to reject, delete, or refuse to deliver videos containing prohibited content without refund. Deliberate submission of prohibited content will result in permanent account termination.

9. Staff Moderation and Delivery

All edited videos are reviewed by Scene Battle staff before delivery to the customer and before any public posting. Scene Battle reserves the right to: approve and deliver videos; reject videos containing prohibited content; or return videos to the editing provider for correction. Customers always receive their edited video after staff approval unless the content is rejected for prohibited behavior.

10. Child Profiles and Parental Responsibility

Adult account holders who create child profiles are solely responsible for supervising their children's use of Scene Battle content, monitoring uploaded content involving minors, and ensuring all content involving minors complies with these Terms. Scene Battle provides category restrictions and default-private settings for minor video content as tools to assist parents, but parental supervision remains the responsibility of the adult account holder.

11. DMCA and Copyright

Scene Battle respects intellectual property rights. If you believe content on our platform infringes your copyright, contact us at legal@scenebattle.com with: a description of the copyrighted work; identification of the allegedly infringing content; your contact information; a statement of good faith belief that the use is unauthorized; and a statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the rights holder.

12. Disclaimer of Warranties

Scene Battle services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that services will be uninterrupted, error-free, or that any particular editing outcome will be achieved. Scene Battle is not responsible for the quality of user-filmed footage, acting performances, or the technical capability of users' recording equipment.

13. Limitation of Liability

To the maximum extent permitted by law, Scene Battle's total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the total amount you paid to Scene Battle in the twelve months preceding the claim. Scene Battle shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

14. Indemnification

You agree to indemnify and hold Scene Battle harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of our services, your uploaded content, your violation of these Terms, or your violation of any third-party rights.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved by binding individual arbitration under the rules of the American Arbitration Association, conducted in Tennessee. You waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Account Termination

Scene Battle reserves the right to suspend or terminate your account at any time for violation of these Terms, submission of prohibited content, fraudulent activity, or chargebacks filed in bad faith. Upon termination, your license to use purchased scripts is revoked and unused credits are forfeited.

17. Changes to Terms

Scene Battle may update these Terms at any time. Material changes will be communicated by email to registered users. Continued use of Scene Battle after updated Terms are posted constitutes acceptance. Contact us at legal@scenebattle.com with any questions.
